Punitive damages do not compensate. They are awarded over and above actual compensation and are assessed by way of penalizing the wrongdoer, making an example to others, and deterring blameworthy conduct. For all practical purposes, punitive damages constitute a fine for misconduct and a windfall for the plaintiff.
