The prevelance of golden parachutes, combined with their lower costs and increased publicity has led to increased challenges towards their enforceability. A recent decision of the Supreme Court of Justice, UPM, Kymmeme Corp. v. UPM - Kymmeme Miramichi Inc. (the "Repap Case"), shows judicial deference is not unlimited and suggests a higher level of care and attention in implementing such agreements may be warranted.
