“In cases where the accused is a corporate executive, the vague concept of dishonesty or breach of fiduciary duty, or breach of some obligation of the corporation that previously could have been viewed as sufficient to include denial of honest services, will no longer be a basis upon which people can be charged with fraud in the United States,” says John Keefe, a litigation partner with the law firm Goodmans LLP in Toronto.
