Brian Empey is a partner in the Corporate Restructuring Group at Goodmans. He practices in the areas of bankruptcy and insolvency, restructuring, creditor remedies, secured transactions and structured financings, including derivatives and asset-backed securitizations.
Brian has particular expertise in restructurings under the Companies’ Creditors Arrangement Act and in insolvencies of securities firms and financial institutions. He has advised a number of debtors in CCAA proceedings and cross-border restructuring, including Toys "R" Us, BearingPoint, Masonite, Atrium/North Star, Calpine Canada, Core-Mark, Laidlaw and The Canadian Red Cross Society. Brian advised the Pan-Canadian Investors Committee concerning their CCAA Plan in the successful $32 billion restructuring of Canadian Third-Party Structured Asset-Backed Commercial Paper. Brian has participated in a number of other noted matters while advising creditors, regulators, committees and court-appointed officers, including Nortel, LightSquared, Indalex, First Leaside Securities, MF Global Canada, General Motors, Chrysler, Planet Organic, Stelco, Air Canada, Confederation Life Insurance Company, Confederation Treasury Services and Microforum.
