The principal vehicle through which foreign insolvency proceedings will enter the United States is Chapter 15 of the U.S. Bankruptcy Code. Proceedings commenced under this Chapter will dictate how asset values are maximized, how proceeds of realization are distributed and what role foreign courts will play in determining the rights and interests of U.S. stakeholders. Recent cases in connection with the recognition of reign proceedings involving the SphinX and Bear Stearns hedge funds demonstrate that Chapter 15 will be at the forefront of some of the most complex, intriguing and ground breaking cases.
