Goodmans partner Calvin Goldman QC, who acted for the Vancouver Airport Authority, said it is “very pleased with the decision and it “significantly” changes the litigation framework for contested cases before the Competition Tribunal, bringing the practice back into line with the requirements of procedural fairness that apply before other administrative tribunals in Canada.
“This means that the commissioner can no longer assert and sustain in such litigation a class based privilege for evidence obtained from third parties in the course of the commissioner’s investigation,” Goldman said.
