There is no law in Canada that specifically makes spyware illegal, says Peter Ruby, a litigator at Goodmans LLP who teaches a course on Internet law at the University of Toronto law school.
But certain kinds of spyware are covered by other laws. For instance, spyware that collects personal information without the user's consent would fall under privacy legislation.
"There are potentially legitimate uses for... contextual advertising, " says Ruby.
