Overview

Daniel Cappe is a partner in the Dispute Resolution Group at Goodmans. His broad-based practice focuses on intellectual property, technology, health care and corporate/commercial litigation.

Daniel is a seasoned litigator with significant experience in prosecuting and defending patent, trademark and copyright infringement actions, proceedings under the Patented Medicines (Notice of Compliance) Regulations, trademark opposition proceedings, shareholder disputes, contractual disputes, tort claims, defamation actions, and oppression actions. Daniel also frequently advises on and prepares contracts and agreements, particularly in the health care and technology industry context. Daniel represents public and private companies, venture capitalists, and other investors.

Daniel has appeared before the Ontario Superior Court of Justice, the Court of Appeal for Ontario, the Federal Court, and the Federal Court of Appeal.

Daniel is recognized in the 2024 edition of The Canadian Legal Lexpert Directory for Litigation – Intellectual Property.

Credentials

Professional Involvement

Daniel has lectured in patent law at the Queen's University Faculty of Law and writes frequently on current topics in intellectual property law. Daniel is a co-author of the Canada chapter in the book Patent Enforcement in the UK and Trans-Pacific Countries, which was published internationally in October 2021 by Globe Law and Business.

Daniel has an active pro bono practice, including acting as duty counsel at Law Help Ontario since its inception in 2008.

Daniel also serves as a director and Secretary of VIBE Arts, an award-winning charitable organization committed to providing children and youth in under-resourced communities with high quality community and school based arts and education. He also previously served as a director of the Toronto Kiwanis Boys and Girls Club (including acting as Secretary and Vice-President) from 2008 - 2014.

Before becoming a lawyer, Daniel worked as a software designer in the high-tech industry for several years.
