With recognized leaders in Canadian litigation law, Goodmans’ litigators have won some of the most important and high-profile cases that have recently been decided in the Supreme Court of Canada, including the litigation involving the proposed acquisition of BCE Inc., the litigation associated with the successful restructuring of Canadian third party structured asset backed commercial paper, and the Danier Leather class action. Goodmans also continues to be a leader in the area of pharmaceutical litigation. Its recent successes include invalidating the Canadian patent associated with the medicine Plavix. Our litigation group has a reputation for being tenacious, energetic and fearless in the courtroom and are prepared to do whatever it takes to meet our clients’ objectives.
Many of our clients are large corporations in litigious industries. Our litigation group covers the full spectrum of disputes, and have litigated virtually everything - with experts in civil litigation, securities, corporate commercial, IP, insolvency and restructuring, construction, libel/slander, employment, technology, real estate and more.
We have acted in numerous matters involving shareholder disputes and hostile take-over bids for public companies; cases involving asset or share purchase agreements, shareholder class actions involving allegations of securities fraud, as well as in proceedings before the Ontario Securities Commission involving such allegations.
Members of the group have acted as counsel on many matters involving commercial and contractual disputes, injunctions, joint venture disputes, reinsurance and insurance disputes, real estate (including nuisance and environmental associated claims) and leasing disputes, employment disputes, enforcement of restrictive covenants involving allegations of breach of fiduciary duties, theft and misappropriation of trade secrets, technology disputes, disputes over infringements of patents and passing off, partnership disputes, landlord-tenant disputes, pension litigation, government litigation, and urgent relief as part of applications for judicial review.
Goodmans’ litigators regularly appear in all levels of court, including provincial and federal trial and appellate courts, as well as the Supreme Court of Canada. We also represent our clients before a variety of administrative and regulatory tribunals. Recognizing that many cases settle, our litigators are true negotiation advocates and have had tremendous success in mediation, arbitration and other alternative dispute resolution strategies. However, when litigation is necessary, we pursue our clients’ objectives while continually evaluating risks, expenses and options.
