Overview

Sarah Stothart is a partner in the Litigation and Dispute Resolution Group at Goodmans. She maintains a broad practice across several areas, but primarily divided between complex commercial, insolvency, and intellectual property litigation.

Sarah's complex commercial practice involves shareholder and oppression issues, fiduciary duty claims, and allegations of contractual breaches and misrepresentations, and representing creditors and court-appointed officers in insolvency, restructuring and receivership matters, for which she appears frequently before the Commercial List. Her intellectual property practice involves patent infringement actions at both the trial and appellate levels, as well as copyright and trademark issues. She also has experience advising and representing clients in competition disputes, technology disputes, data breaches and cybersecurity incidents, and regulatory proceedings involving energy and copyright. 

Sarah has appeared before all levels of Ontario superior courts and Canadian federal courts, as well as the Supreme Court of Canada. She has also appeared before arbitration panels, the Competition Tribunal, the Ontario Energy Board, and in the US before the Delaware Court of Chancery. She is licensed to practice in Ontario and California.

Featured Work

Sarah’s representative work includes acting for:
  • Atlantic Lottery Corporation on a successful appeal to the Supreme Court of Canada, where the Court overturned a certification order and dismissed a class action relating to video lottery terminals and clarified the law relating to waiver of tort
  • Vancouver Airport Authority in successful defence of a landmark abuse of dominance application brought by the Commissioner of Competition before the Competition Tribunal, seeking orders pursuant to section 79 of the Competition Act
  • Creditors and Court-appointed officers in various insolvency and receivership proceedings under the Companies’ Creditors Arrangement Act and Bankruptcy and Insolvency Act, including relating to Cresford Developments, Tacora Resources, and “The One” skyscraper being constructed at Yonge/Bloor in Toronto
  • Patent-holders and innovative technology companies in patent infringement lawsuits, including Google in an infringement action against Sonos relating to voice-recognition speakers and AP&C (an affiliate of General Electric Aviation) in an infringement action relating to titanium metal powders used in 3D printing
  • Two directors in connection with an investigation of alleged insider trading by a company special committee and the Ontario Securities Commission

From 2017 to 2019, Sarah sat on the Board of Directors of Newcomer Women’s Services Toronto, a non-profit organization offering employment, settlement, and language services for newcomer women.
